Traumatic brain injuries are classified by both severity and mechanism. By severity, TBIs range from mild to moderate to severe. By mechanism, they are either closed injuries, caused by blunt force without skull penetration, or penetrating injuries, where an object enters the skull and brain tissue directly.

Liability & Proof in Louisiana Brain Injury Cases

To succeed in a Louisiana TBI claim, the injured party must establish four elements: the at-fault party owed a duty of care, they breached that duty, the breach caused the brain injury, and the injury produced compensable damages. Who owes that duty depends on the facts of each case.

Potentially liable parties include at-fault drivers in motor vehicle accidents, property or business owners whose unsafe premises caused a fall, employers who violated workplace safety requirements, product manufacturers whose defective goods caused the injury, medical providers whose negligence led to harm, and individuals who committed assault. Identifying every liable party from the outset matters because Louisiana law affects how recoveries are divided among them.

Louisiana follows a modified comparative fault rule. Under Louisiana Civil Code Article 2323, an injured person can recover compensation as long as their share of fault is 50% or less, with their award reduced by their percentage of fault. If a claimant is found 51% or more at fault, they are barred from recovery entirely. This rule applies to accidents occurring on or after January 1, 2026. The prior pure comparative fault system governs earlier incidents. Either way, sharing some responsibility for an accident doesn’t automatically end your claim.

Louisiana personal injury deadlines can vary based on the date of injury and other case-specific factors. Missing the applicable filing deadline generally bars recovery regardless of how strong the underlying case is. Acting promptly after a TBI also protects evidence: accident scene documentation, medical records, surveillance footage, and witness accounts become harder to obtain the longer time passes. Building a complete TBI case typically requires medical records, accident reports, expert medical testimony on injury severity and prognosis, and expert financial testimony on lost earning capacity and future care costs.
